Terms and Conditions of Use and Protection – Aureus IA 2025

Article 1 – Purpose

These Terms govern the access and use of the Aureus IA platform, coworking hub, web interface, and analytical tools powered by artificial intelligence.

Article 2 – Automatic Acceptance

Any user who:

• connects to Aureus IA through an API key,

• makes any payment, even partial,

• or accesses an Aureus workstation physically,

is deemed to have read, understood, and accepted these Terms in full.
Such acceptance constitutes a binding digital signature.

 

Article 3 – Nature of Services

Aureus IA provides analytical and educational software tools.
It does not provide financial advice, portfolio management, or investment recommendations under FSMA, SEC, or any equivalent regulation.
All outputs are informational and educational in nature.

 

Article 4 – Access to Services

Access is granted via license, subscription, or API key.
Each key is personal, non-transferable, and remains the property of Aureus IA.
Unauthorized sharing or resale will result in immediate suspension without refund.

 

Article 5 – Responsible Use

Users agree to operate the platform in accordance with:

• Belgian and European law,

• these Terms,

• and Aureus IA’s internal security policies.

Any fraudulent or unethical use will trigger contractual sanctions.

 

Article 6 – Data Privacy and Security

All data is processed in compliance with:

• EU Regulation 2016/679 (GDPR),

• the Belgian Law of 30 July 2018,

• and international cybersecurity standards (ISO 27001).

Aureus IA applies full encryption and European-based secure storage.

 

Article 7 – Intellectual Property Protection

All content, algorithms, interfaces, training materials, and visuals belong exclusively to Aureus IA and are protected by:

• the Belgian Code of Economic Law,

• EU Directive 2019/790,

• the Berne Convention (1886),

• and the Digital Millennium Copyright Act (USA).

Any unauthorized use, duplication, or disclosure will result in:

• a contractual fine between €500,000 and €1,000,000,

• immediate termination of access, and

• civil and criminal prosecution under applicable law.

Article 8 – Limitation of Liability

Pursuant to Article 1231-3 of the Belgian Civil Code, Aureus IA’s total liability shall never exceed the amount paid by the user during the previous three (3) months.
No compensation shall be due for loss of profit or indirect damages.

 

Article 9 – Suspension and Blocking

Aureus IA may suspend or block any account or API key:

• in case of non-payment,

• misuse,

• or any attempt to circumvent system integrity.

Suspension may occur without prior notice or compensation.

 

Article 10 – Penalties and Fines

Violation of these Terms exposes the user to:

• a fine of €500,000 to €1,000,000,

• immediate termination of contract, and

• judicial prosecution under Belgian Civil Code Articles 1382 and 1728.

 

Article 11 – Network and System Security

Any hacking attempt, unauthorized data extraction, or reverse engineering is a criminal offense under Articles 550bis and 550ter of the Belgian Penal Code.
Aureus IA will immediately notify competent authorities.

 

Article 12 – International Compliance

Aureus IA operates in compliance with:

• Belgian law,

• European Union regulations,

• OECD standards,

• and the U.S. Patriot Act for international compliance.

Any fraudulent or cross-border misuse will result in transnational legal action.

 

Article 13 – Trademark and Brand Use

The name “Aureus IA,” its logo, and visual identity are registered trademarks.
Unauthorized use constitutes a violation under EU Regulation 2017/1001 and the Belgian Intellectual Property Code.

 

Article 14 – Training and Coaching

Any training, coaching, or workshop provided by Aureus IA is strictly educational and does not constitute investment advice.

 

Article 15 – Dispute Resolution

Any dispute shall fall under the exclusive jurisdiction of the Courts of Brussels (Belgium).
The applicable law is Belgian law, supplemented by European and international standards.

 

Article 16 – Duration and Termination

The contract takes effect upon first payment or connection.
It remains valid until terminated by Aureus IA in case of breach or misuse.

 

Article 17 – Force Majeure

Aureus IA shall not be held liable for delays or damages resulting from force majeure such as system failure, war, cyberattack, or natural disaster.

 

Article 18 – Contract Integrity

If any clause is found invalid, the remaining provisions shall remain in full effect.

 

Article 19 – Assignment of Contract

The user may not transfer or assign this contract without Aureus IA’s prior written consent.

 

Article 20 – Client Data Retention

Client data is retained for ten (10) years for accounting and compliance purposes, in accordance with Belgian law.

 

Article 21 – Non-Disparagement Clause

Any public statement or online comment that discredits Aureus IA may lead to prosecution under Articles 443–444 of the Belgian Penal Code.

 

Article 22 – Audit and Compliance

Aureus IA reserves the right to audit access logs and API activity for regulatory and security purposes.

 

Article 23 – Digital Consent

Accessing the platform, making payment, or connecting via secure link constitutes irrevocable consent to all Terms herein.

 

Article 24 – Updates

These Terms may be updated periodically.
The latest version is always available on the official website www.aureus-ia.com.

 

Article 25 – Final Clause and Enforcement

By using Aureus IA, the client acknowledges:

• having read and understood all 25 articles;

• accepting the legal applicability of Belgian, European, and international law;

• and being aware that any breach may lead to fines between €500,000 and €1,000,000 and immediate account termination.
